Trials commonly involve disputes about many issues. Successful appeals, in contrast, almost always turn on a few, critical issues. It is essential, therefore, that appellate counsel have the experience and judgment to identify the best possible issues to raise on appeal.

The time within which to file an appeal can be quite short. In addition, the preservation of issues for appeal can sometimes require that other steps be taken, such as filing a post-trial motion in district or superior court. If you are considering an appeal, you need to understand as quickly as possible what steps must be taken to preserve all issues and to timely file your appeal.

What should I do if I need to appeal a criminal conviction or sentence?

If you are looking to appeal a criminal conviction or sentence, you should speak to a knowledgeable criminal appellate lawyer as soon as possible. Tim Anderson has handled numerous criminal appeals in federal and state court. He knows how to evaluate and refine the issues raised by trial counsel. Just as important, by taking a fresh look at the case, he can also discover significant issues that trial counsel may have missed. He knows how to identify the issues that are most likely to prevail on appeal, and how best to present those issues to the appellate courts. Tim Anderson ensures that his clients’ rights on appeal are fully protected.

What is a fraud?

Typically, a fraud occurs when someone is deceived in order to obtain money, property or services from them.

What is mail and wire fraud?

The federal mail and wire fraud statutes cover most any type of fraud that in some way uses the “mail” or “wire.” “Mail” includes not only the United States Postal Service but also any mailings sent through a private commercial carrier. “Wire” includes the use of a telephone, television, radio, internet, computer or other communication device. To prove mail or wire fraud, a prosecutor must prove beyond a reasonable doubt that a defendant somehow used the mail or other communication device to perpetrate a scheme with the intent to commit fraud. Frequently, mail and wire fraud charges are used in conjunction with more specific type of fraud charges, such as bank fraud or insider trading.

What should I do if I am charged with mail or wire fraud or I am believe I am being investigated?

Mail fraud or wire fraud is a serious charge with severe consequences. An indictment of mail or wire fraud will be based upon a significant and detailed investigation. It is important to discuss your rights, potential defenses and case strategies with an experienced white collar defense attorney if you believe that you may be under investigation or as soon as you are indicted. Early preparation by an experienced defense lawyer can increase your chances of a favorable outcome, including the possibility of you not being charged or of charges being dropped.

If you are being investigated for or have been charged with mail or wire fraud, the Law Offices of Timothy R. Anderson can help. Tim Anderson has extensive experience in handling mail and wire fraud cases.

While all federal criminal cases contain elements of complexity, it is in the sentencing phase of the case, where federal cases require an attorney who fully understands the complexity and ambiguity presented by the interaction of the federal sentencing guidelines and case law.

Under recent U.S. Supreme Court precedent, including Blakely v. Washington and United States v. Booker, the federal sentencing guidelines are no longer treated as mandatory. Because they are now advisory, the judge needs to take them into consideration, but the guidelines do not dictate the sentence. The recent cases of Rita, Gall, Kimbrough, and Spears solidified the discretion that a sentencing judge has to deviate from the advisory guideline range. More than ever, the terms of a sentence may be influenced by well-crafted arguments of counsel. You want an attorney experienced in handling the complex arguments necessary to obtain the best possible sentencing result in light of this new treatment of the federal sentencing guidelines.

What should I do if I am facing being sentenced in federal court?

If you are charged with a federal offense, you should speak to a knowledgeable federal criminal defense and sentencing lawyer as soon as possible. At the Law Offices of Timothy R. Anderson, Tim Anderson’s understanding of the federal sentencing guidelines allows him to develop arguments that best serve his clients. The goal in any federal sentencing matter is to minimize the federal sentence that is imposed. Tim Anderson has extensive experience in handling the sentencing phase of federal criminal cases, and has achieved outstanding results in dozens of federal cases.

While most crimes are considered state crimes, extremely serious crimes affecting interstate commerce usually fall under the category of federal crimes. Federal crimes can result in severe punishments and penalties.

If you have been charged with or are under investigation for a federal crime, it is important to understand that many criminal defense lawyers do not have significant experience in federal cases. Federal courts have their own sentencing guidelines, rules of evidence, and procedures. If you are being investigated for or have been charged with a federal crime, the Law Offices of Timothy R. Anderson can help. Tim Anderson has successfully handled virtually all types of federal criminal cases.

Examples of federal crimes include:

In addition to severe legal punishment, these charges come with collateral consequences that can affect employment, the right to possess firearms, and immigration status. Whether you are experiencing your first encounter with the law or you have previous offenses, a talented defense attorney can help you.

What should I do if I have been accused of a federal crime?

If you have been charged with a federal crime of any type, or are being investigated by federal authorities, you need an effective and experienced federal criminal defense lawyer. In order to avoid serious and unwanted penalties, it is extremely important to hire a knowledgeable and respected attorney as soon as possible, to ensure your case has the best possible outcome. Tim Anderson has extensive experience in handling federal cases, having achieved exceptional results for clients in a wide range of federal charges.
